Child Custody in Saskatchewan

Courts can order various arrangements: sole custody (one parent has primary care), joint custody (shared decision-making), or shared parenting (significant time with both parents). The arrangement depends on what's best for the children.

Courts consider the child's needs, each parent's ability to meet those needs, the child's existing relationships, stability, the child's views and preferences, and any history of family violence.

Saskatchewan encourages parents to create parenting plans covering: where children will live, how decisions will be made, holiday and vacation schedules, and communication between homes.

Moving with children requires following the Divorce Act's relocation provisions, including proper notice to the other parent. The rules differ based on whether you have majority parenting time.
