Spousal Support in Quebec

Both spouses have an obligation to support each other during marriage. Upon divorce or separation, the court can order support if one spouse needs it and the other can pay. The goal is to address economic disadvantage from the marriage.

Quebec courts look at the length of the marriage, roles during the marriage, each spouse's age and health, current and potential income, property division results, and any agreements between the parties.

Quebec courts use the Spousal Support Advisory Guidelines as a reference tool, though the Civil Code provisions remain the legal framework. The guidelines help determine appropriate ranges for amount and duration.

Unlike property rights, Quebec law DOES provide support obligations for de facto (common-law) spouses under art. 585 CCQ in limited circumstances. This is based on economic dependence created during cohabitation.
