Property Division in PEI

Family property includes assets acquired during marriage: the family home, vehicles, savings, investments, pensions. Generally divided equally.

Property owned before marriage, gifts, and inheritances may be exempt. The family home receives special treatment regardless of acquisition.

The family home is always subject to division. Both spouses have equal rights regardless of title or when it was acquired.

Courts can order unequal division if equal sharing would be unfair considering relevant factors.
