Frequently Asked Questions
At what age can a child choose which parent to live with in California?
There's no specific age when a child can choose. California courts consider the child's preference if the child is mature enough to express a reasoned preference. At age 14, a child can request to address the court directly about custody preferences, and the court must allow it unless it finds doing so is not in the child's best interest.
How is child support calculated if we share 50/50 custody?
Even with 50/50 timeshare, the higher-earning parent typically pays some support. The guideline formula considers both timeshare and income. If both parents have equal income AND equal timeshare, guideline support would be $0. But any income disparity produces a support amount.
